Please read the Subscriptions and automatic renewal and Disputes sections carefully. They explain how recurring charges work and how any disagreement between us will be resolved.

What StackRx is, and what it isn't

StackRx is a technology platform. It connects you with independent, US-licensed healthcare providers and with independent, state-licensed pharmacies.

Your provider decides, using their own professional judgment, whether a treatment is appropriate for you. Your pharmacy is responsible for preparing and dispensing your medication. Neither is an employee or agent of StackRx.

Not for emergencies

If you think you are having a medical emergency, call 911 or go to the nearest emergency room right away. Do not use the Platform or wait for a provider's message.

The Platform is not designed for urgent care. Provider reviews happen over time, not in real time, and messages may not be answered right away.

StackRx is also not a replacement for a primary care provider. Please keep seeing your own doctor for routine and ongoing care.

Who can use StackRx

To use the Platform, you must:

StackRx is currently available in Arizona, Colorado, Florida, Georgia, Illinois, Indiana, Kentucky, Missouri, Ohio, Pennsylvania, South Dakota, Tennessee, and Wisconsin. This list may change. Some treatments may not be available in every one of these states.

Your account

You'll need an account to start an online visit or place an order. You may have only one account.

Online visits and prescriptions

How it works

  1. You complete an online questionnaire about your health history and goals. For some treatments, you may be asked to upload photos.
  2. A US-licensed provider reviews your answers. Reviews usually happen asynchronously, which means not in a live conversation. Your provider may message you with questions, or ask for more information or a live visit before deciding.
  3. Your provider prescribes a treatment only if they decide it's appropriate for you.
  4. If a treatment is prescribed, a licensed pharmacy compounds it and ships it to you.

No guarantee of a prescription

Completing a visit or paying for one does not guarantee that you'll receive a prescription. Your provider may decline to prescribe, may recommend a different option, or may refer you to in-person care. Those decisions are theirs alone.

Your responsibilities

Your care is also governed by the Telehealth Consent, which you'll be asked to accept before your visit.

About compounded medications

The treatments offered through the Platform are compounded medications. A licensed pharmacy prepares each one for an individual patient, based on a prescription.

Information on the Platform about treatments is general and educational. It is not medical advice and doesn't replace a conversation with your provider.

Prices and payment

Prices are shown on the Platform before you check out. [Whether the provider visit fee is separate from, or included in, the treatment price]

Payments are processed by [Payment processor]. By giving us a payment method, you confirm that you're allowed to use it, and you authorize us to charge it for your orders, including recurring charges for any subscription you choose.

You're responsible for any applicable taxes. If a payment fails, we may pause your order or subscription until the payment method is updated.

If we offer an introductory price or promotion, we'll show you the regular price, and when it starts, before you check out.

Subscriptions and automatic renewal

Many treatments are offered as subscriptions, so your refills arrive on a regular schedule. Here's how a subscription works:

Pausing and canceling

Shipping

Your pharmacy ships prescribed medications to you free of charge, in plain packaging. We'll share tracking details when they're available.

Returns and refunds

Each medication is compounded for you, and pharmacy rules generally prevent dispensed medications from being returned. For these reasons, medications can't be returned once they've shipped.

Communications

We may send texts about your account, orders, and refills if you give us your mobile number and agree to receive them. When you use the Platform, you agree not to:

Intellectual property

The Platform, including its design, text, graphics, images, and software, belongs to StackRx or its licensors and is protected by law. StackRx, the StackRx logo, and related names and designs are trademarks of [Legal entity name].

We give you a personal, limited, non-transferable right to use the Platform for its intended purpose, as long as you follow these terms. You may not copy, change, distribute, or create works based on the Platform without our written permission.

Your content

You own the information you submit, such as intake answers, photos, and messages. You give us permission to use it to operate the Platform and provide services to you, as described in our Privacy Policy.

If you send us ideas or feedback, we may use them without owing you anything.

Copyright concerns

If you believe content on the Platform infringes your copyright, contact [Copyright agent name and contact details] with a description of the work, where it appears on the Platform, and your contact information.

Third-party services

The Platform relies on services from other companies, such as our payment processor and shipping carriers, and may link to other websites. We're not responsible for their content or practices, and their own terms may apply.

Privacy

Our Privacy Policy and Consumer Health Data Privacy Policy explain how we handle your information. The Medical Group and the pharmacies handle your medical and pharmacy records under their own privacy notices.

Disclaimers

To the fullest extent the law allows, the Platform is provided "as is" and "as available." We don't promise that it will always be available, error-free, or secure.

StackRx does not provide medical care and does not make clinical decisions, so we are not responsible for the medical judgment of providers or the professional services of pharmacies. We don't guarantee any particular health outcome from any treatment.

Some states don't allow certain warranties to be disclaimed. If you live in one of them, some of these disclaimers may not apply to you.

Limitation of liability

To the fullest extent the law allows, StackRx will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Platform.

To the fullest extent the law allows, our total liability for any claim relating to the Platform or these terms is limited to [Liability cap, e.g., the amount you paid StackRx in the 12 months before the claim].

Nothing in these terms limits liability that the law does not allow to be limited.

Indemnity

If you break these terms or the law, or give false information through the Platform, and that leads to a claim against StackRx, you agree to cover the reasonable costs of that claim, including legal fees, to the extent the law allows.

Suspension and termination

You can stop using the Platform and close your account at any time.

We may suspend or close your account if you break these terms, if we suspect fraud or misuse, or if we need to for legal or safety reasons. If we close your account, we'll cancel any active subscription and stop future charges. [Treatment of prepaid, unshipped orders on termination]

Sections that by their nature should continue after your account closes, such as those on payment, intellectual property, disclaimers, limitation of liability, and disputes, will continue.
